Money matters

The ongoing federal probe into alleged pay-to-play politics in Illinois demonstrates attempts to influence state business by donating to political campaigns. But the Illinois Campaign for Political Reform released another round of campaign contribution totals this week that seem to reinforce the fact that money drives politics behind the scenes, as well.

The Illinois Senate Democrats will pick a replacement for Senate President Emil Jones Jr., who retires in January. Since Jones announced his retirement, a lengthy list of candidates has started campaigning to replace him. The caucus will need 30 votes to select a new president. Watch for more about the candidates in the November edition of Illinois Issues magazine. UPDATE: Here's the story.

One way those candidates are trying to differentiate themselves is through cash. The more money they can raise for their political campaigns, the more they appear capable of strengthening an already extraordinarily big Democratic Caucus (of 59 total senators, 37 belong to the Senate Democratic Caucus).

According to two nonpartisan think tanks, the Illinois Campaign for Political Reform in Chicago and the Sunshine Project in Springfield, Senate presidential candidates have doled out more than $1 million to their party candidates and incumbents.

The top two givers are Sen. James Clayborne of Belleville and Sen. John Cullerton of Chicago, two who repeatedly have been mentioned as front-runners in the race to replace Jones.

Clayborne has given $418,000 to other Senate Democrats, while Cullerton has doled out $336,000. According to the Campaign for Political Reform, Clayborne has transferred money from his own political committee, Friends of Clayborne. Top donors to that fund include the Illinois Education Association, AT&T and Ameren Corp.

Cullerton has used money from his committee, Citizens for John Cullerton, but he also formed a new committee, the Senate Democratic Victory Fund. Top donors to both funds include Chicago Wolves chairman Don Levin; Sen. Heather Steans of Chicago, her husband Leo Smith and her parents; and the Illinois Hospital Association. We’ll talk more about the Democrats who are receiving these funds in another blog.

Political insiders are used to Jones raising that much money or more ($3.6 million in 2006), but when these new candidates aren’t even president yet and are raising those amounts, the totals are striking. But it’s also part of the legislative process in Illinois.

“The leader is supposed to help raise a lot of money, and that’s part of their job,” says David Morrison, assistant director of the Illinois Campaign for Political Reform. “Part of what Cullerton and Clayborne are doing here is showing that they can shoulder that kind of burden, [that] they help their colleagues in that regard.”

Yet, this is one time when Morrison — ironically for a campaign finance reformer — says it’s not all about money. This internal election is about context. So even though these numbers look big, there are many other factors that are in play for whom the next Senate president will be.

  • Jones’ retirement: It means the person whom businesses donated to in the past is no longer the person who will funnel the funds to other Democratic members. Without knowing who will serve as the hub for accepting donations and funneling them to other Democrats, donors have to take their chances.
  • The Obama factor: It translates into record numbers of Democrats who will come out to vote for U.S. Sen. Barack Obama for U.S. president and who likely will continue voting Democratic down most of the ticket. Democrats are expected to have a good year, so money in some ways is less important this year than it was in 2004 and 2006, when Jones was trying to build on a majority of seats in the chamber.
  • Personality: Then there’s a question of which qualities that Senate Democrats want in their next leader. The most common characteristic cited is someone who can compromise and refresh the atmosphere in the Capitol, thereby breaking the stalemate of Gov. Rod Blagojevich and his ally Jones against House Speaker Michael Madigan.

But the money is still important. It’s not just who is giving, but why are they giving? Morrison says it’s hard to tell if the Senate presidential candidates are attracting new donors, getting increased donations from patron donors or if it’s a combination. It’ll be easier to tell when the next detailed campaign finance reports are due in January. One thing is for sure, he says: “There’s a lot of money flowing around.”

Updates to Legislative, Judicial, and Cook County State's Attorney Races

59th District Senate Race Likely to Break Record

As the 2008 General Election campaigns head into the final weekend, candidates in hotly contested races have reported record amounts of campaign fundraising. Although most legislative races are uncontested, the top ten legislative races, those that appear winnable to both parties, have reported almost $12 million in receipts to date. And the race for the 59th Senate Seat in far Southern Illinois is posed to break the old record for spending in a state Senate campaign.

The Illinois Campaign for Political Reform (ICPR) and the Sunshine Project have also examined contributions in state judicial races and the Cook County State's Attorney. This analysis found a handful of trial court races that are likely to see over $100,000 in combined spending. The only seat on the state Supreme Court and all three seats on the appellate courts are uncontested, but several circuit (trial) court races have reported large receipts.

Legislative Races

As usual there have been large infusions of money from political committees controlled by the four legislative leaders. But because Senate President Emil Jones, D-Chicago, will retire soon, several contenders for that position have raised more than $1 Million and they are using that money to make contributions to the campaigns of other Democrats seeking to retain or win seats in the Senate

Top Senate races include:

(1) In the 59th District, Sen. Gary Forby, D-Benton, reported $1,175,600 while his opponent, Republican Ken Burzynsksi of Benton reported $840,400, for combined $2,016,000. This race is well within striking distance of the spending record for a Senate seat. The previous record was set in this same District in 2006, when Sen. Forby and then-challenger Ron Summers combined to spend $2,465,000.

(2) In the 42nd District, Republican Terri Ann Wintermute of Bolingbrook, reported $789,500 while Sen. Linda Holmes, D-Aurora, reported $782,300 while her opponent, for a combined $1,571,700.

(3) In the 26th District, Republican Dan Duffy of Lake Barrington reported $796,800 while Democrat Bill Gentes of Round Lake reported $173,200 for a combined $970,000 in the race for the open seat left by the retiring William Peterson, Republican of Long Grove.

(4) In the 45th District, appointed Republican Sen. Tim Bivins of Dixon reported $760,000 while Democrat Marty Mulcahey of Galena reported $178,700 for a combined $938,700 in the race for the open seat left by the retiring Sen. Todd Sieben, Republican of Geneseo.

(5) In the 33rd District, Sen. Dan Kotowski, D- Park Ridge, reported $658,900 while his opponent, Republican Michael Sweeney of Arlington Heights reported $247,400 for a combined $906,300.

Top House Races include:

(1) In the 85th District, Rep. Brent Hassert, R-Romeoville, reported $778,200 while his opponent, Democrat Emily Klunk-McAsey of Lockport reported $510,100 for a combined $1,288,200.

(2) In the 92nd District, Democrat Jehan Gordon of Peoria reported $636,200 while Republican Joan Gordon Krupa of Peoria Heights reported $584,900 for a combined $1,221,100 in the race for the open seat left by Republican Aaron Schock of Peoria, now a candidate for U.S. Congress.

(3) In the 69th District, Challenger Greg Tuite, D-Rockford, reported $578,700 while incumbent Republican Ron Wait of Hinkley reported $417,000 for a combined $995,700.

(4) In the 96th District, Democrat Dianne McGuire of Naperville reported $534,800 while Republican Darlene Senger of Naperville reported $386,800 for a combined $921,700 in the race for the open seat left by the retiring Republican Joe Dunn of Naperville.

(5) In the 17th District, Rep. Beth Coulson, Republican of Glenview, reported $458,400 while Democrat Daniel Biss of Evanston reported $352,700 for a combined $811,100.

One candidate in one race has reported receipts of more than $1 million. Rep. Jay Hoffman, D-Collinsville, reported having $1.7 million available, including $479,400 raised since July 1, and $113,500 of that in the last week alone. Rep. Hoffman's Republican opponent, Dwight Kay of Glen Carbon, reported $305,400. Whether this race sets a record or even crosses the million dollar spending mark depends entirely on Hoffman's assessment of how much he is willing to spend to hold on to the seat.

Judicial Races

Circuit Court races have traditionally seen smaller fundraising than legislative contests. Fewer interest groups have gotten involved, and the size of the districts and number of voters has typically been smaller. Because the size of circuits varies so widely around the state, it is difficult to draw comparisons between one race and another, and it is difficult to say what the record would be for spending in these races. In the 2008 General Election, the Circuit Court races with the most fundraising include:

(1) In the 16th Circuit in Kane, DeKalb and Kendall counties, Republican Patricia Piper Golden of Dundee reported $114,700 while Democrat John Noverini of Carpentersville reported $105,100 for a combined $219,800.

(2) In the 2nd Circuit in southeast Illinois, Republican David Overstreet of Mt. Vernon reported $132,600 while Democrat L. James Hanson of Mt. Vernon reported $40,900 for a combined $173,400.

(3) In the Cook County 12th Subcircuit Devlin vacancy, Democrat Pamela Lora of Mt. Prospect reported $102,500 while Republican Laura Morask of Park Ridge reported $56,800 for a combined $159,400.

(4) In the 1st Circuit in the southernmost part of Illinois, Democrat Steve Stone of Cartersville reported $81,000 while Republican James R. "Randy" Moore of Cartersville reported $33,700 for a combined $114,600.

(5) In the Cook County 4th Subcircuit, Democrat Patrick Rogers of Western Springs reported $87,900 while Republican Maureen Masterson-Pulia of Westchester reported $9,900 for a combined $97,800.

What's striking about judicial races this year is that none of the contests for county-wide seats in Cook County -- one for Supreme Court, two for Appellate Court, and nine for Circuit Court -- are even contested. This tactical retreat by the Republicans (and Greens) recalls the 2000 election, when a similar decision in the Supreme Court race allowed the Democrats to send resources to their candidate in the nominally Republican Third District. The $700,000 infusion, considered massive at the time, helped elect a Supreme Court Justice.

In these 2008 contests, we see the same dynamic playing out, as well-funded Democrats are running strong in the nominally Republican 4th and 12th subcircuits. There are no similarly well-funded Republicans or Greens in largely Democratic subcircuits. A change in campaign finance laws, to offer either public financing options or incentives for small donations, may alter this dynamic, which deprives most voters in Cook County of any real choice when voting for judges.

Cook County State's Attorney

The hottest race in Cook County appears to be for the State's Attorney's office, left open by the retirement of Democrat Dick Devine. Democrat Anita Alvarez of River Forest has reported $736,000 in receipts while Republican Tony Peraica of Riverside has reported $179,400 for a combined $915,400.

ANSWER: They will blame people known as "conservatives" and "platform Republicans," that is, people who are involved in Republican politics to advance the party's platform. They will argue that those people:

Double Think (I Think)

And it looks like it's a Con Con blogging hat trick today.

I'm thinking that the push for a Constitutional Convention is going to get a huge boost when word of this gets out.
Gov. Rod Blagojevich said today that he doesn't support a convention to rewrite the state's 1970 constitution because he fears attempts to strip some of his executive powers.
Chalk that one up in the understatement of the month club.

The Governor then went on to explain how fortunate Illinoisans have been to have him at the helm, and in the process, infers that God has given the green light for the Governor to grind Springfield to a halt.
"Thank God that the constitution gives the executive branch a lot of power to get around the legislative branch," Blagojevich said, adding that without his ability to issue executive orders or use his amendatory veto power there would be no free mass transit rides for seniors or free breast and cervical cancer exams for women.

"If the constitutional convention were to occur and there was an effort to erode the executive branch's ability to do those things, then I think less good things would happen for people," Blagojevich said.
(Since he mentioned the free rides program that he pulled out of, um, thin air that blew a $40 million dollar hole in the CTA budget, let me just mention that in my entire tenure as a legislator, I have never met a senior citizen who complained about a free anything. But the majority of local seniors that I have spoken with since the program was launched have said that they thought the idea was unnecessary and a political stunt.)

Getting back on point, I sincerely believe that in light of the already-existing political climate in our state, as well as the Governor's recent poll numbers, the Governor's opposition to a Con Con may be just enough to get it passed.

But in the surreal world in which we find ourselves, you then have to think that the Governor would realize that his opposition would have a positive impact on the issue. Which could mean that deep down, he actually wants it to pass. Which is making me wonder if that means that I should actually be against a Con Con. Oh, that Governor Blagojevich, he's a crafty one.

Operation Board Game snags another piece

The U.S. attorney’s office in Northern Illinois is advancing its way around Gov. Rod Blagojevich’s inner circle, and Thursday’s indictment of GOP political bigwig William Cellini could be just another attempt to recruit one more person to testify against the governor, says Kent Redfield, political scientist with the University of Illinois at Springfield.

U.S. Attorney Patrick Fitzgerald indicted Cellini today on four charges of federal corruption. The 21-page indictment spells out a classic pay-to-play scheme of trading political campaign cash for state business. But Cellini’s attorney, Dan Webb of Winston & Strawn in Chicago, already combats the charges as “unfair and unjust” and based on shaky evidence.

The feds allege that Cellini was one of many people who conspired to rig state boards to hire investment firms that would, among other financial benefits, donate to the political campaign of Public Official A, previously identified as Blagojevich. The scheme allegedly happened between spring 2003 and summer 2005. Other conspirators already charged include Blagojevich insider Tony Rezko, former state board member Stuart Levine, attorneys Joseph Cari and Steven Loren and construction contractor Jacob Kiferbaum. Cellini’s indictment lists two more: Co-Conspirator A and a Teachers Retirement System Staffer A, yet to officially be identified. Co-Conspirator A is widely thought to be Christopher Kelly, who already was indicted on separate charges of tax fraud.

Cellini’s indictment alleges that he participated in a scheme to pressure Chicago businessman Thomas Rosenberg to give money to Blagojevich’s political campaign. The alleged ultimatum was that Rosenberg’s company, Capri Capital, had to raise money or donate to Blagojevich’s political fund to get a $220 million business deal with the Teachers’ Retirement System. The system oversees and handles investments for public pensions of teachers and administrators outside of Chicago. Private investment firms handle TRS assets. Through a statement, TRS administrators declined to comment but said the staff will “continue to uphold their fiduciary duty to our participants.”

According to Cellini’s indictment, the schemers decided it was too risky to continue pressuring Rosenberg when he threatened to go to authorities. But after that, Cellini, Rezko and others “discussed the possibility of removing the U.S. attorney for the Northern District of Illinois in an effort to stop any investigations into the co-conspirators and others,” according to the indictment.

Webb’s statement describes Cellini as “completely innocent of these charges, and he will fight this case because he has done absolutely nothing wrong.” It highlights the point that while a grand jury found Rezko guilty of 16 counts of corruption, they found him not guilty on one of the most serious charges of attempted extortion, relating to the charges involving Rosenberg. It states that Rosenberg testified in Rezko’s trial that “Bill Cellini never asked him for any money and that Rosenberg never paid any money to Cellini or anyone else.”

Redfield says if the assumption is that the U.S. attorney’s ultimate goal is to get all the way to Blagojevich, indicting Cellini makes sense. But there's no guarantee it'll work.

“At this point, Cellini thinks that this is not a slam dunk,” says Redfield. “And he’s willing to be indicted rather than to cooperate.”

And if the federal grand jury agrees with prosecutors’ assessment of Cellini’s involvement in the scheme, why would a successful, wealthy political insider at all levels of government work to secure funds on behalf of Blagojevich, a Democratic governor? Redfield says it’s all about power. “I don’t think it was so much about fighting for the governor as it was about power in the board and playing the game. He was as mover and shaker when [Jim] Thompson, [Jim] Edgar and [George] Ryan were governors. That’s what he knows and what he does … Power is addictive.”

Don't Be Afraid

Okay Okay. I get it. As I've been reminded by multiple messages in the last few days, I've completely slacked off on the blogging. And not to make excuses, but it's been a combination of post-session burnout and most of the focus being on national issues, which really isn't my thing on this blog.

So let me dip my toes back into the blogging waters with this thought and video. The debate over Con-Con has been raging, and I don't think that the opponents thought that the supporters would have as much traction as we do. I am hardly saying that I feel very confident that it's going to pass, but right now, I do think that we are definitely within striking distance. Not McCain-type striking distance but real striking distance.

What's frustrating is that so much of the opposition has been based in fear-mongering rather than articulated issues. And while I don't want to rehash the arguments here, I think that the following ad captures this sentiment pretty decently.



One last note. Given the sporadic to non-existent compliance with the court ruling requiring voters to be provided with corrected ballot language, I would find it hard to believe that a loss on the ballot question would not be followed by a lawsuit. I'll discuss it more if it comes to pass, but for now, I just wanted to posit that thought with you.

A new direction

Mike Lawrence, director of the Paul Simon Public Policy Institute at Southern Illinois University Carbondale, is retiring from the institute November 1. He started in 1994 as associate director and became director in 2004, shortly after the unexpected death of former U.S. Sen. Paul Simon.

"You can’t really replace in some senses either Paul Simon or Mike Lawrence, but we’ve got to find someone who will carry on. And we have some very capable, accomplished people in the pool," says John Jackson, political science professor at the university and head of the search committee to replace Lawrence.

An interim director will be announced shortly, and the search committee expects to publish the top three candidates some time in November. A new director may not start until January, according to Jackson.

The new director will take over as the economic downturn continues to manifest itself in new ways. Lawrence told us in the spring that one reason he felt comfortable retiring is because Simon's goal of building a $10 million endowment had been accomplished and then some. But Jackson says just as universities throughout the state are experiencing lower returns on their investments, so too is SIUC. “The endowment is fine," Jackson says. "It’s the income off the endowment that’s not quite what it had been. So right now, we have what we hope is a short-term cash flow problem. Not huge, but it’s a headache for us.”

While Lawrence is packing his books into boxes, the university will continue to benefit from the stamp that Lawrence put on the institute and its agenda, Jackson adds. "He’s focused us more on Illinois issues, Illinois concerns, and I think that has been his forte because that’s where his network and his contacts were."

Before spending a decade with the Edgar Administration, Lawrence spent 25 years as a journalist, including 20 years with Lee Enterprises and its Statehouse bureau that he helped start and another year as Statehouse bureau chief for the Chicago Sun-Times. He plans to return to writing political commentaries, which he has said he stopped after being pressured to do so in the interest of the institute and of the university. He remains vice chair of the Illinois Issues Advisory Board.

Contenders to the Senate Presidency Donate Over $1 Million to Democratic Candidates to the State Senate

Belleville's Clayborne, Chicago's Cullerton Lead in Giving

In the weeks since Senate President Emil Jones, D-Chicago, announced he would not seek reelection, contenders to replace him as Senate President have given more than $1 million to the campaigns of the candidates who likely will select the next Senate President -- other Democratic senators running for reelection and Democratic newcomers challenging Republican incumbents.

An analysis by the Illinois Campaign for Political Reform (ICPR) and the Sunshine Project demonstrates the giant leap in campaign contributions by the men seeking to replace Jones. In the 18 months prior to Jones' retirement announcement, these senators transferred just $61,300 to other Senate Democrats.

"While money is easy to quantify, Senate Democrats will likely consider several factors when choosing their next leader," said Cindi Canary, Director of ICPR. "But it looks like they believe supporting other senators now with campaign funds will prompt those same senators to return the favor later by voting one of the benefactors into the top Senate job."

If the contest to succeed Jones turns on money, the top two candidates will be Sen. James Clayborne, D-Belleville, who has given $418,000 to other Senate Democrats, and Sen. John Cullerton, D-Chicago, who has given $336,000.

Illinois has no limits on transfers of funds between candidates and no limits on contributions by special interests to candidates. Many of the donations made by the contenders would be illegal if made between candidates in most other states, or between candidates for federal office.

It will take 30 votes to elect the next Senate president. If neither Clayborne nor Cullerton can put together a coalition of 30 of their colleagues, a compromise candidate may emerge. Based on their transfers to Democratic Senate candidates, this second tier would include Sen. Don Harmon, D-Oak Park, who has transferred $70,000; Sen. Jeff Schoenberg, D-Evanston, who has transferred $60,000, and Sen. Terry Link, D-Waukegan, who has transferred $58,000. Others giving at least $10,000 include Sen. Ira Silverstein, D-Chicago, Sen. John Sullivan, D-Rushville, and Sen. A.J. Wilhelmi, D- Joliet.

Sen. Clayborne has transferred money from his own political committee, Friends of Clayborne. Top donors to his political committee include the Illinois Education Association, AT&T and Ameren.

Sen. Cullerton has used money from his committee, Citizens for John Cullerton, but he has also formed a new committee, the Senate Democratic Victory Fund. Top donors to his two funds include Chicago Wolves Chairman Don Levin, Sen. Heather Steans, D-Chicago, her husband Leo Smith, and her parents Harrison and Lois Steans; and the Illinois Hospital Association. Of the second tier, only Sen. Schoenberg has created a new committee, Deep Blue Illinois, to augment giving by his own committee.

The show of fundraising prowess comes as the Senate Democrats hold 37 of the 59 seats in the Senate, with hopes that a strong Democratic turnout for their former colleague and current Democratic Presidential nominee Barack Obama will further bolster their numbers. Giving by the Illinois Senate Democratic Fund (ISDF), the caucus political committee which is still controlled by Senate President Jones, has been down appreciably this year compared to recent cycles (ISDF expenditures are down from $2.4 million in the comparable period in 2004 and $3.6 million in 2006 to $803,000 in 2008), but these presidential contenders have helped to make up some of the decline. Most of funds from contenders have been transferred to incumbents, but a handful of challengers are also benefiting. Top beneficiaries include:

• Sen. Gary Forby, D- Benton: $300,000
• Sen. Linda Holmes, D-Aurora: $241,000
• Sen. Dan Kotowski, D-Park Ridge: $92,000
• Candidate Bill Gentes, a Democrat from Round Lake: $84,500
• Candidate Peter Gutzmer, a Democrat from Hoffman Estates: $76,500

Traditionally, legislative caucuses have looked to their leader to play several important roles. Fundraising is one of these, but other factors are expected to include political acumen in a divisive climate and responsiveness to caucus members. This is the first time a caucus leader has stepped down since 2003, when the new legislative map gave control of both chambers to the Democrats. Sen. Emil Jones has led the Senate Democratic Caucus since the retirement of Sen. Phil Rock in 1993.

When Obama proposed legislation as a state senator in Springfield, it was often Roskam who would stand up on the other side of the aisle to criticize it. Roskam was an early supporter of John McCain in the GOP primary this year and Obama cut a TV ad for the Highland Park Republican's previous challenger, Tammy Duckworth, in 2006. So it was curious when Roskam established an "Obama Voters for Roskam" Web site and sent out related mailers appealing to Obama supporters in his run for a second term in the 6th District. Campaign spokesman Matt Vriesema says Roskam is reaching out to Obama supporters because internal polling indicates they can hope to get a third of them to switch sides down ballot. "This election is not about party politics. It is about sending people to Washington who can get things done, and a lot of people are looking to Congressman Roskam for that," Vriesema says. Roskam's move to grab a hold of Obama's coattails marks the second DuPage Republican to do so this campaign season. State Sen. Kirk Dillard of Hinsdale appeared in a TV ad for Obama praising his bipartisanship early in the primaries. Democratic challenger Jill Morgenthaler said voters will not be helping Obama by voting for Roskam. "He will spend his whole time undermining anything Sen. Obama wants to do," Morgenthaler said. "To me, this is a desperate move in his behalf to fool the voters." Vriesema says the flier and Web site are not meant to indicate an Obama endorsement. However, the Web site does feature an Obama quote from a debate on the state Senate floor in 2004. The Obama quote says, "First of all, I am a member of the mutual admiration society with Senator Roskam. He is always terrific." The quote came from a sparring match between Roskam and Obama over legislation the Chicago Democrat proposed to tighten rules defining overtime. After praising Roskam - typical form for Senate floor debate - Obama said, "Having said that, have I said that he's wrong? I love him, but he's wrong." Roskam opposed the overtime rules because he said they would chase businesses out of Illinois. The Obama campaign declined to comment.)

The Web site opens with an Obama quote: "I'm a member of the mutual admiration society with Sen. Roskam. He is always terrific." Roskam's opponent, former U.S. Army Reserve Col. Jill Morgenthaler, notes the quote is part of a larger one in which Obama explains he disagrees with Roskam. Roskam is on the opposite side of "virtually every issue" -- the Iraq war, abortion, tax cuts for the wealthy, the bank bailout -- from Obama and Morgenthaler, she said. "Roskam would continue President Bush's failed policies and [Obama] is supporting Jill Morgenthaler for Congress," Obama spokesman Ben LaBolt said. Roskam's spokesman said the Web site was appropriate because 30 percent of Roskam supporters are voting for Obama. Roskam represents the traditionally Republican 6th Congressional District, which sent Henry Hyde to Washington for decades. But Democrat Tammy Duckworth came within two points of taking it two years ago. Duckworth had $8 million and strong support from national Democrats. Morgenthaler has only $750,000 and no national buzz. But she will have Obama's coattails. Republicans blame Illinois' "Obamamania" for Democrat Bill Foster's surprise win next door in Denny Hastert's old district earlier this year. State Constitution: If it’s not broke . . .

While both sides have valid arguments, we at Chicago Urban League feel it is important for voters to remember that the vast majority of the problems African Americans face do not stem from flaws in our state Constitution. A shortage of good-paying jobs, failing schools and lack of access to capital to fund businesses–none of these problems will go away by attacking our state Constitution with a red ballpoint pen. High crime rates, scarce affordable housing and deteriorating infrastructure in our neighborhoods–these are social ills that cannot be blamed on the Constitution. In fact, the estimated $40 million to $80 million cost of a Constitutional Convention could be better spent purchasing computers for public schools on the South and West sides, or hiring more highly skilled teachers in the toughest neighborhood schools.

As for education funding, the Constitution already clearly spells out the responsibility of the state to provide a high quality education to all of its citizens, and it's high time for Illinois lawmakers to honor that.

In 1808, the designers of the state's original Constitution wrote in a useful feature for making changes to the document: It's called an amendment. We, at the Urban League, believe the tools to lead Illinois forward are already in the hands–or certainly within reach–of our legislative leaders. The other tool lies in your hands. As a voter, you have the power to elect the candidates you believe will make the changes our community needs. If you're not informed about who you want to vote for, their policies and their track records, then I suggest you do your homework before Tuesday rolls around.

Election Season Rhyme and Reason

Should the citizens of Illinois hold a Constitutional Convention?

I wrote about this issue a few weeks back. And the answer is that yes, they should. The only compelling argument I've heard against the Con-Con was that it could endanger state and local employee pensions. That seems to be unlikely if not untrue — due to the federal Constitution's so-called "contracts clause," and also because pensioners are probably the most well-organized constituency group against the Con-Con, so I don't think they'll be left weeping on the sidelines when the Con-Con comes.

The reasons to support it are myriad.

First of all, the problem with Illinois politics is not the current "bums," and therefore the solution to the problem is not one that could be solved by throwing the current bums out. The problem with Illinois politics is a system that concentrates an enormous amount of power in very few hands; a districting system that allows politicians to choose their voters, rather than vice versa; and an education funding formula that makes equal opportunity nearly impossible.

Secondly, the fear of "special interests" dominating the Con-Con process is ridiculous on its face, particularly because it is being offered by a coalition of special interests. But the system is blind to which special interest is benefitting from the system. Sometimes, progressive or "good" interests are able to dominate the political climate in Springfield; sometimes, it has been the "bad" interests. I don't want to be in the position today of supporting a system because my "team" benefits, and then be left with no arrows in my quiver when the other team takes control.

Third, the left has an ideological duty to support measures that devolve power to the greatest possible number — as close to "the people" as possible. We cannot say we are for democracy sometimes, but then oppose it when we fear its outcome. Certain rights cannot be infringed, even by majority whim — the right to vote, the right to privacy, due process, etc. — but most of the rules that effect our civic lives get their legitimacy from majority rule, and every chance to bring the policy making process to the grassroots level should be supported, or we risk making hypocrites of ourselves either in the future or in the past.

Rich Miller has provided the most elegant argument about how the concentration of power compromises the political system. And it's a simple argument: Carefully constructed legislative districts make only a handful of seats competitive, and the majority party's leadership controls the legislative process from beginning to end. There is no chance for elected officials to meaningfully buck their parties, or forge a policy or legislative consensus outside of party leadership. If you want to get something done, you have to deal with Michael Madigan, and Madigan alone, in the House. Ditto (for the time being) for Emil Jones in the Senate. This kind of concentration of power constricts the "marketplace of ideas" that should reflect the diversity of opinion in the state, while also ironically making it easier for the largest organized interests to buy their way into favor.

And, at the end of the day, the voters still get a chance to vote the new constitution up or down. Personally, I believe in the people's ability to govern themselves — even if the process may seem chaotic to us.

Vote Yes for a Con-Con. If you're afraid of what the results could be, pay attention to the process. Organize. Be a delegate. But don't ever say no out of fear — because that's the message the anti forces are sending out: "If we call a Con-Con things could get better; but they could also get worse." Americans — left, right, center — have a voracious appetite for change right now. But change doesn't come to the timid.

As Thomas Jefferson said, "Timid men... prefer the calm of despotism to the boisterous sea of liberty." I'm not scared of a bit of boisterousness — are you?

The Ethics of the Ethics Vote

To paraphrase a major newspaper columnist, a little bird told us that some challengers are trying to turn the vote to enact the pay-to-play ban despite Gov. Blagojevich's veto against incumbents. These challengers are apparently claiming that the vote to override the veto was a vote against ethics. Nothing could be further from the truth.

HB 824, the pay-to-play bill, was a hard-fought, carefully-vetted measure with wide support, under the dome and outside of it. The Governor's re-write was sloppy and likely unconstitutional.

After the Governor vetoed HB 824, the correct, ethical vote was to override his veto. We commend all legislators who made that decision.

The Neo-Cons Trying to Buy the Election in the 10th

Mark Kirk likes to pretend that he's a moderate. But the fact is, he's no moderate -- he's voted with George Bush 90% of the time. By comparison, the ultra conservative Peter Roskam has voted with George Bush 90% of the time.

At least Roskam is honest. Mark Kirk doesn't have Roskam's integrity. Despite being the chosen candidate for the Club for Growth, Kirk has long pretended that he was "independent" and a political moderate. Kirk obviously thinks that his constituents are stupid.

The Club for Growth, according to its own website, "has become a power broker of sorts with the conservative movement," and "has become a force in congressional elections, taking aim at moderate Republicans."

So it came as no surprise when the Neo-Con independent group, Freedom's Watch, invaded the IL-10's airwaves in support of Mark Kirk. While Kirk may try to represent himself as an independent or political moderate, inside the Beltway, his friends know that they can count on him. Just as they can count on ultra-conservative Peter Roskam.

Freedom's Watch says that its goal is to support mainstream conservative public policies. It "collaborate[s] with like-minded groups and individuals to further our common goals. Freedom’s Watch provides a credible conservative voice and strong leadership on pressing domestic and international issues." It continues:

Freedom’s Watch distinguishes itself as the first full-time nonpartisan movement dedicated to preserving, protecting, and defending conservative principles and promoting a conservative agenda. In the past, the conservative movement came strongly together during election cycles but weakened its presence during off-cycles. Freedom’s Watch is a long-term movement that will be a force for conservative action from year-to-year. Freedom’s Watch is dedicated to helping build a stronger, more unified conservative movement for generations to come.

Freedom's Watch announced its formation through Ari Fleischer: "There's been a three-year silence from conservatives and others who believe in peace through strength. The cavalry is coming, we're going to help to get that message out." Bradley Blakeman, then its president, said that Freedom's Watch was founded because “there was a large vacuum on the conservative side."

The conservative cavalry has come to Kirk's defense because he is locked into a heated battle with Democratic candidate Dan Seals. Instead of Kirk's fealty to the failed Bush policies on the economy and the war on terrorists, Seals offers the Tenth a real choice -- and a real change from the failed policies that got us stuck in Iraq (while Osama bin Laden slipped out of our grasp) and brought us an economic crisis unknown for decades. While Seals has an admirable set of goals for the next Congress:

1. Bringing a responsible end to the war in Iraq

2. Strengthening our economy

3. Developing a universal healthcare system

Mark Kirk says: "My top priority after re-election will be to prevent Governor Blagojevich from squandering billions of federal transportation dollars."

While this is certainly a noble goal, Kirk either thinks his constituents are idiots or he's extraordinarily naive politically. After 8 years in Congress, doesn't Mark Kirk understand the difference between federal and state governments? What does Kirk propose to do to "prevent Governor Blagojevich from squandering billions of federal transportation dollars?" Well, he's going to demand an explanation! Kirk says, "Governor Blagojevich and Springfield legislators owe the citizens of Illinois an explanation as to why they are letting federal money go to other states due to their inaction."

If you didn't recognize it, this is Kirk's shtick. He talks about things he can't do anything about (such as the political paralysis in Springfield) while ignoring all those things he can (like voting against Bush's reckless policies, both abroad and at home). We aren't supposed to realize that Kirk is a good soldier, loyal not only to the failed Bush agenda, but a foot soldier in the broader conservative movement.

Kirk is a political Trojan Horse. While he pretends to be a "thoughtful independent" and Congressional moderate, his votes -- and his friends -- demonstrate otherwise. The Club for Growth and Freedom's Watch did not put in hundreds of thousands of dollars into Kirk's campaigns because he was a "thoughtful independent" or a political moderate. One would have to be foolish to think otherwise. They supported Mark Kirk because they knew that he was a reliable vote for the conservative cause -- even if he tried to sweeten those votes with a little image makeover for the dweebs at home. In politics, image is everything. Mark Kirk has made a fool out of his constituents.

But there is hope! Dan Seals' campaign for change has caught fire -- which is why the Neo-Con Freedom's Watch has entered the fray. Kirk himself may be afraid to show his face in the district, but his conservative buddies have taking it upon themselves to protect him:

A conservative group with ties to the Bush administration has donated about $453,000 for television ads to benefit GOP Rep. Mark Kirk's tough re-election bid in Chicago's affluent suburbs.

They wouldn't do that for a real moderate. In fact, everyone knows that the Club for Growth tries to defeat moderate Republicans, not support them. And these conservative groups certainly aren't rewarding independence. Their support comes at a cost. Mark Kirk just hopes you don't notice it.

TOP 10 DONORS TO LEGISLATIVE CONTESTS GAVE $4.3 MILLION

Same Donors Gave Another $440,000 to Anti-Con-Con Group

With a week to go before Election Day, many candidates for General Assembly are raising campaign money at a furious pace and just 10 contributors account for nearly 20 percent of all funds raised by legislative candidates in recent months.

A dozen legislative races are approaching or have passed the $1 million mark; all told, legislative candidates have raised more than $20 million since July 1.

The Illinois Campaign for Political Reform (ICPR) and the Sunshine Project examined campaign disclosure reports filed by incumbent legislators and candidates for the General Assembly to compile this list of top donors.

Illinois has no limits on the source or size of campaign contributions. Many of these groups have made contributions to candidates that would be illegal if made to candidates in other states or for federal office. Much of this money is reported as receipts by caucus and party leaders, who in turn transfer funds to individual candidates.

Many of these Top 10 donors have also helped fund the opposition to a referendum to authorize a state constitutional convention. The Alliance to Protect the Illinois Constitution (APIC), a political organization formed earlier this year to oppose the "con-con" has raised at least $1.2 million since July 1, including $440,000 from these top legislative donors. By contrast, two organizations in support of the con-con, Con Con Yes and Metro Chicago United PAC, have together reported total receipts of just $5,000.

(THE ARTICLE: In "The Big Sort," author Bill Bishop describes how people tend to self-segregate by moving near others who are predisposed to think like them. One of the principles of his theory is that lifestyle determines a person's politics, and a recent survey conducted by Kelley Blue Book seems only to add credence to Bishop's argument. The survey's most surprising discovery was just how well the actual data hewed to Republican and Democratic stereotypes. By wide margins, domestic-car owners preferred Republican presidential candidate John McCain. The "buy-American" crowd broke down with 61% of GMC owners, 60% of Chevy, 58% of Buick and Dodge, and 57% of Ford saying they would vote for McCain. The Arizona senator also led in owners of luxury vehicles, including 52% each of BMW, Lexus and Lincoln owners. Meanwhile Democratic presidential candidate Barack Obama dominated among small-import owners like Mini (70%), Subaru (61%), Saab 59% and Honda (50%). Vehicle segments broke down predictably as well with full-size truck, SUV and luxury-SUV owners all preferring McCain by wide margins, while Obama has the support of wagon and hatchback owners (including luxury wagons). The Illinois senator also did well with the luxury-crossover segment and hybrid owners, where he held a nine point lead over McCain. The all either evaluated or tried to implement HOV lanes by using existing lanes and either decided it would not work or had to remove the HOV lanes.

Are pensions safe in a Con-Con?

Illinois voters have eight days to decide whether they want the state to call a constitutional convention. For those who want to know the pros, cons or the logistics, look at Illinois Issues magazine, which has published numerous articles in print and online throughout the past year (see the list below). But one specific question burning in the minds of many current state employees, a.k.a. voters, is whether a convention would rip away their pensions and retiree health benefits.

In fact, that fear will lead many of those employees to vote “no” on the referendum. People on both sides of the Con-Con debate agree that the state’s obligations to its existing employees, particularly those who are not fully vested in the pension system, is open to interpretation.

It’s generally agreed that the state’s future public employees would be vulnerable to change. Potential reforms include increasing the retirement age before a person could tap into his or her benefits, limiting automatic yearly pension increases and increasing the employee contribution rate by at least 1 percent. Existing employees are different. On one hand, courts have ruled — and the Illinois Constitution of 1970 declares — pensions are contractual relationships between the state and its employees. The state Constitution, Article 13, Section 5, reads:

Membership in any pension or retirement system of the state, any unit of local government or school district, or any agency of instrumentality thereof, shall be an enforceable contractual relationship, the benefits of which shall not be diminished or impaired.

Even if the state charter changed, legal challenges likely would cite protection under the U.S. Constitution, Article 1, Section 10 (scroll down to see “Section 10”) that says states cannot breach contracts, including pension obligations.

Elena Kezelis, former chief counsel for then-Gov. Jim Edgar, says she interprets the Constitution as protecting those who are fully vested in the pension system as having unalterable rights. She points to the back of the state Constitution, where a “savings clause” would protect every contract in place if a new document were approved. If another convention were called and pension benefits were revised, then she says that provision would grandfather in the existing pension contracts. Prudent drafters would include that kind of language again, she says.

The question is, she says, how delegates and how courts would define the point at which current state employees are vested into a contractual right that cannot be taken away from them.

Bruno Behrend, co-founder of the Illinois Citizens Coalition that supports a constitutional convention, says he agrees with the same interpretation: Pension benefits of vested employees could not be taken away. And he says he doesn’t think delegates would erase that constitutional guarantee because the goal of a convention would be to draft a new constitution that would win voter approval. Taking away benefits that have been promised to existing employees wouldn’t go over so well with voters, he says. Instead, he supports pension reforms aimed at making the state more accountable in chipping away at some $100 billion in pension debt.

One main force behind a campaign to oppose a convention disagrees with the interpretation that the pensions of active public employees are safe. Among the reasons the Illinois Federation of Teachers union opposes a convention is that there's no telling what would happen, according Steve Preckwinkle, IFT's political director. “Our belief is that if Article 13, Section 5 of the Constitution were to be either eliminated or modified in certain ways that the pension security of active government employees throughout the state at all levels of government could be jeopardized.”

The IFT also is the top donor to a statewide campaign to defeat the November 4 referendum. It and affiliate members have contributed $300,000 to the Alliance to Protect the Illinois Constitution, according to the Illinois Campaign for Political Reform, a Chicago-based think tank that keeps track of campaign contributions. The second top donor is the Illinois Education Association, donating $225,000.

Ann Lousin, who opposes a convention, says pension reforms are a “perfect example of how a lack of political will on the part of officeholders can lead to a constitutional crisis.”

She is a former research assistant for the 1970 Con-Con, a former parliamentarian for the House in the 1970s, a former chair of the Illinois State Civil Service Commission and a current law professor at John Marshall Law School in Chicago. In a recent paper for the Social Science Research Network, Lousin points out that the intent of the 1970 Constitution, Article 13, Section 5, is unknown and that there’s little legislative or court record on the subject. She says case law from the New York Constitution of 1938, upon which the Illinois section is based, suggests that the contractual guarantee applies only to the pension, not to such companion benefits as health care. And, she says, because legislators lack political will, they fail to fully fund the five state pension systems. That will result in dire consequences in the not too distant future. “By most estimates, the crisis will come by 2020 or 2025 when an Illinois pensioner will not receive a pension check.”

It's easy to assume that with or without another constitutional convention, public employee pensions are at risk in the future.

He/she can tap into Law Enforcement Agencies Data System (LEADS for short).

That might be the wrong thing to do, at least in Kane County, where Kane County State's Attorney John Barsanti has just indicted Steven Cordes, according to a Tuesday (Elgin) Courier-News article written by Mike Bailey.

18 felony counts of official misconduct.

EIGHT GENERAL ASSEMBLY BATTLES HAVE PASSED OR ARE NEAR THE $1 MILLION MARK AND OTHERS LIKELY TO JOIN

Southern Illinois Senate Contest Could Break $$$ Record

Campaign contributions to election battles for four state legislative seats have passed the $1 million mark, and four others should soon reach the $1 million level, according to research by the Illinois Campaign for Political Reform (ICPR) and the Sunshine Project.

One of those campaigns – a contest for state senator from the most southern district in the state – could break the $2.4 million record for most money spent by candidates running for the Illinois General Assembly.

A total of at least $1.89 million in campaign contributions has been reported by the campaigns of Sen. Gary Forby, D-Benton, and Ken W. Burzynski, a Republican also from Benton, and both candidates are still collecting contributions to pay for advertising and other expenses in the final days of the campaign.

In 2004, the combined spending of campaigns by Forby and Ron Summers, his 2004 opponent, established a new spending record of $2.4 million.

The 2008 Forby-Burzynski contribution total stands at $1.89 million. That total, as well as others totals in this report, represents the available balance of funds for each candidate on June 30 and individual contributions reported by the campaigns between July 1 to October 24. The exact amount of spending won’t be made public until next January.

The races reporting the biggest fundraising totals to date follow:

• Senate District 59, total of $1,895,099 -- Forby, $1,112,395; and Burzynski, $782,703.

• Senate District 42, total of $1,381,057 -- Sen. Linda Holmes, D-Aurora, $715,692; and Terri Ann Wintermute, a Republican from Bolingbrook, $665,364.

• House District 85, total $1,156,874 – Rep. Brent Hassert, R-Romeoville, $740,784; and Emily Klunk-McAsey, Democrat from Lockport, $416,090.

• House District 92, total $1,050,014 – Jehan Gordon, Democrat from Peoria, $531,156; and Joan Gore Krupa, Republican from Peoria Heights, $518,857.

• Senate District 26, total of $894,306 – Dan Duffy, Republican from Lake Barrington, $732,099; and Bill Gentes, Democrat from Round Lake. $162,207.

• Senate District 45, total of $874,464 – Sen. Tim Bivins, R-Dixon, $712,721; and Marty Mulcahey, Democrat from Galena, $161,742.

• Senate District 33, total of $866,042 – Sen. Daniel W. Kotowski, D-Park Ridge, $628,285; and Michael H. Sweeney, Republican from Arlington Heights, $237,757.

• House District 69, total of $833,583 – Greg Tuite, Democrat from Rockford, $538,151; and Rep. Ronald A. Waite, R-Belvidere, $295,432.

• House District 17, total of $797,872 – Rep. Elizabeth Coulson, Republican from Glenview, $447,195; and Daniel Biss, D-Evanston, $350,676.

• House District 96, total of $701,086 – Dianne A. McGuire, Democrat from Naperville, $497,659; and Darlene J. Senger, Republican from Naperville, $203,427.


Because such large sums are being contributed to these candidates, most of these races appear to be competitive or were considered to be winnable by both parties at some time during the campaign season. However, the vast majority of legislative races are dominated by one candidate, and some incumbents don’t even have an opponent on the ballot.

All 118 House seats and 39 of the 59 Senate seats are at stake this year, but many of them are uncontested. Only 21 Senate seats and 60 House seats have two or more candidates on the ballot, and of those, only about 18 total appear to be attracting substantial contributions.

Tossup: the Fall of Mark Kirk

This story got me thinking. Fact: Peter Roskam "votes with Bush over 90% of the time. Fact: he votes in favor of tax breaks for Big Oil. Fact: he voted against veterans benefits."

So what's the difference between Mark Kirk and Peter Roskam?

Image, of course. In politics, image is everything. Voters are supposed to ignore the wizard behind the curtain.

Mark Kirk says that he's a moderate, but he has the same voting record (in this regard) as Peter Roskam. Mark Kirk says that he's independent, but he has the same loyalty towards the president and his party as Peter Roskam.

Peter Roskam will tell you that he's a conservative. At least he's honest about it. But that's probably because Roskam has stronger ties to his district than Mark Kirk. Roskam represents what he believes his district wants. Kirk pretends to.

The fact that both Mark Kirk and Peter Roskam have voted with George Bush 90% of the time shows how much they are creatures of the body they serve. Mark Kirk's so-called independence comes in votes on bills that don't matter. It's like they are both dogs tied to the same pole (the Republican party). Sure, Mark Kirk likes to play over in a different corner than Peter Roskam -- and maybe even bark at different passers-by -- but they are both tied to the same pole. And they are both loyal to the same party.

When George Bush needed their votes, they were there. When the Republican leadership required their votes, they were there. Peter Roskam has the integrity to tell you that he's a loyal Republican and a conservative to boot. Mark Kirk likes to pretend that he's not. But the facts inform us to the contrary.

Mark Kirk likes to pretend that he's an effective legislator while the reality is that he's not. Think about it. What has Kirk *really* done? Kirk's big strategy is to pretend that he accomplishes things, to take credit whenever he can (have you heard that Kirk is responsible for preventing BP for dumping pollutants into Lake Michigan -- except that it's not true.) Kirk obviously believes his constituents are idiots.

The Mark Kirk is an effective legislator meme shows Kirk's utter contempt for the truth. Roll Call, a newspaper that focuses on coverage of Capitol Hill, publishes what it calls unabashedly Power Rankings. These annual rankings have long demonstrated Kirk's relative ineffectiveness in Congress. If you look at the list, Kirk (257) is right behind Dennis Kucinich (256), in the bottom half of the list. But despite the fact that Roskam was elected six years after Mark Kirk, he's only 16 places below Kirk.

The comparison is even more stark when you think about their relative performance in their respective "classes" (or year they first arrived in Congress). Mark Kirk is smack dap in the middle of his class, (what you'd call average), while Roskam is ranked as the highest (or most influential) Republican in his class.

You may remember that Mark Kirk had strong ties to Donald Rumsfeld and Dennis Hastert. Rumsfeld pretty much destroyed our military forces and Hastert is no longer in Congress. Mark Kirk remains, but as a rudderless Republican who is left with nothing but his loyalty to the Republican party. Despite claims to the contrary.

You can see the influence that Mark Kirk has over the party to which he is supremely loyal in the GOP Platform:

Faithful to the first guarantee of the Declaration of Independence, we assert the inherent dignity and sanctity of all human life and affirm that the unborn child has a fundamental individual right to life which cannot be infringed. We support a human life amendment to the Constitution, and we endorse legislation to make clear that the Fourteenth Amendment’s protections apply to unborn children. We oppose using public revenues to promote or perform abortion and will not fund organizations which advocate it. We support the appointment of judges who respect traditional family values and the sanctity and dignity of innocent human life.

We have made progress. The Supreme Court has upheld prohibitions against the barbaric practice of partial-birth abortion. States are now permitted to extend health-care coverage to children before birth. And the Born Alive Infants Protection Act has become law; this law ensures that infants who are born alive during an abortion receive all treatment and care that is provided to all newborn infants and are not neglected and left to die.

Mark Kirk and his supporters will observe that he opposes his party here (and, perhaps, others) but what matters is his votes. And, like Peter Roskam, he votes with his party 90% of the time.

Kirk thinks his constituents are stupid and won't figure out that loyalty to party is more important that loyalty to district in the U.S. House of Representatives. Sure, he'll be given the freedom to "vote his conscience" (or district) when the votes don't matter. But when push comes to shove, it is loyalty that is expected. And Mark Kirk delivers -- for the Republican Party.

Like John McCain and Sarah Palin, Mark Kirk doesn't seem to have a clue about the economic crisis that threatens us today. While Kirk hasn't said that he thinks the fundamentals of our economy are strong, he has "demonstrated a fundamental lack of understanding of economics." Without the haunting spectre of 9-11, what does Kirk stand for? Is he even relevant?

In the end, Mark Kirk is a vestage of the past. He's Donald Rumsfeld's "boy." But Rumsfeld has left the scene, and the president to which Kirk has been so loyal is about to join him. Kirk didn't have the guts to run against Dick Durbin (despite many in the party pushing him to do so), and he's made it clear that he's not a friend of the next president. So this election really is a test of whether or not the 10th Congressional District's voters are as dump as Kirk thinks they are.

Kirk has long tried to minimize the threat represented by Dan Seals, his Democratic opponent. But the respected Cook Political Report has listed this race as a tossup. The biggest reason is that the Obama ground game will not only boost Democratic turnout but the long association with Seals and Obama is much more potent with Barack at the top of the ticket. We can only imagine what Kirk's "shoot on sight" comment will do for black voter turnout.

So you can see why Mark Kirk is running scared. Mark Kirk is running with Sarah Palin and Dan Seals is running with Barack Obama. Kirk is certainly hoping that voters are as dumb as he thinks -- and that Obama doesn't have any coattails. Because, if he does, this is the district where it will matter.

Poll: Two-thirds of Illinois voters want federal-style tax brackets

For the full story, check out Progressive Advocacy, but a Paul Simon Institute poll shows that 66% of voters want a progressive, federal-style income tax with higher tax rates for higher tax brackets. 


Hopefully we'll either vote yes on a constitutional convention so that we can put a progressve income tax amendment on the 2010 ballot or the General Assembly will do what they failed to do in 2008 and put the amendment on the 2010 ballot. Then the next Governor, whoever he or she may be, can implement a progressive income tax with the General Assembly in 2011 and do what two-thirds of the state wants.

"Down with the flat income tax!" says a super-majority of the state.

ICPR STUDY SAYS ILLINOIS ECONOMIC INTEREST STATEMENTS ARE WOEFULLY INADEQUATE

MOST POPULAR ANSWERS ON FORM: “NONE” AND “DOES NOT APPLY”

State and local candidates on the November ballot are required to complete “Statements of Economic Interest,” but the government form requires so little information that most answers are of little to no value to voters, according to the Illinois Campaign for Political Reform (ICPR).

Because the questions on the form seek minimal information about income, investments and potential conflicts of interest, 28 percent of all state legislators and their opponents in the 2008 election answered “none” to all eight questions on the Statement of Economic Interest (SEI).

ICPR examined SEIs filed by incumbents and candidates for the General Assembly, the six statewide officeholders and candidates for open judicial seats. The findings included:

• More than 75 percent of SEI questions were answered with “None” or “Does Not Apply.”

• A side-by-side comparison of the state and federal forms submitted by congressional candidates who are members of the Illinois General Assembly demonstrated the weakness of the Illinois SEI. The federal forms revealed information about personal income and investments that did not even have to be mentioned on the Illinois form.

• Fourteen of the 280 state legislators and challengers disclosed a “close economic association” with a lobbyist but did not – and were not required to – disclose any information about the magnitude of the “economic association.”

• Even though the Illinois Constitution and state statutes make it clear that candidates for state office must file statements of their economic interest and all do file SEIs prior to the primary election, more than one-quarter of the candidates for the General Assembly did not file updated forms prior to the May 1 deadline for filing forms detailing economic interests for 2007.

“Upwards of 100,000 public officeholders and employees complete these forms every year, and virtually all of them are worthless,” said Cynthia Canary, ICPR Director. “Voters deserve to know the sources and amounts of income and about the investments held by state and local officials, but Illinois laws are so weak that the Statements of Economic Interest hide much more than they disclose to the public.”

ICPR’s report made the following recommendations for strengthening state requirements:

• The Illinois Statement of Economic Interest should mandate reporting of the person’s source and amount of income; value of investments and income from each; the purchase and sale date of investments; and whether investments and income accrue to the filer, spouse or minor child.

• Information should be reported about investments held outside of Illinois, as well as those currently reportable investments within the state, and the disclosure threshold for investments should be low enough to capture all investments of $100 or more.

• In addition to asking the identity of any lobbyist maintaining a “close economic relationship” with the filer, the SEI should elicit information about lobbyists who are related to the filer, and the extent of their financial benefit.

• SEIs should be filed electronically and in a searchable format.

• Winners in primary elections should be required to file new reports for the previous calendar year no later than May 1 of the election year.

• Enforcement of the economic disclosure laws should be enhanced, and the Illinois Secretary of State should be required to conduct random audits to determine the accuracy of filed SEIs.

“Illinois’ Statements of Economic Interest are deplorable,” said David Morrison, Deputy Director of ICPR and lead researcher and writer of the study. “The questions on the form were drafted more to obfuscate than to enlighten. By failing to ask meaningful questions and demand detail, the questions keep potential conflicts of interest hidden, and Illinoisans are left in the dark.”
